Terms of Service

1. Acceptance of Terms

By accessing or using UpIce("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including league administrators, coaches, players, and any other visitors.

2. Description of Service

UpIce is a hockey analytics platform that provides game tracking, statistical analysis, video integration, and AI-assisted coaching reports for recreational, youth, junior, and college hockey leagues. Features include but are not limited to: game event tracking, player and team statistics, computer vision player tracking, video playback, and generated analytics reports.

3. Account and Access

Access to UpIce is granted on an invitation basis during the early access period. You are responsible for maintaining the confidentiality of your account credentials. You agree not to share access with unauthorized users. UpIce reserves the right to suspend or terminate accounts that violate these terms.

4. User Obligations

  • You must provide accurate information when creating an account or submitting access requests.
  • You may not use the Service for any unlawful purpose.
  • You may not attempt to reverse-engineer, scrape, or disrupt the Service.
  • You are responsible for all activity that occurs under your account.
  • You agree to obtain consent before uploading video footage of minors. See our Privacy Policy for details.

5. Data and Content

You retain ownership of game data, video, and statistical content you upload to UpIce. By uploading content, you grant UpIce a limited license to process, store, and display that content to authorized users within your league or organization. We do not sell your data to third parties. We may use aggregated, anonymized data to improve our algorithms and services.

6. Intellectual Property

The UpIce platform, including its software, design, analytics models, and branding, is the intellectual property of UpIce. You may not copy, distribute, or create derivative works without written permission.

7. Fees and Billing

Subscription fees are billed monthly or annually as agreed at signup. All fees are non-refundable unless otherwise stated. UpIce reserves the right to change pricing with 30 days advance notice. Founding teams who join during the early access period will have their pricing locked for 12 months.

8. Limitation of Liability

UpIceis provided "as is" without warranty of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to data loss, service interruptions, or inaccurate analytics outputs. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.

9. Termination

Either party may terminate service with 30 days notice. UpIcemay terminate immediately for material breach of these terms. Upon termination, you may request an export of your league's data within 30 days. After that period, data may be deleted.

10. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email with at least 14 days notice. Continued use of the Service after the effective date constitutes acceptance.

11. Governing Law

These terms are governed by the laws of the State of Colorado, United States, without regard to conflict of law provisions. Disputes shall be resolved in the courts of El Paso County, Colorado.

12. Text Messaging (SMS)

By providing your mobile phone number and ticking the SMS consent checkbox at signup, you agree to receive text messages from UpIce. These are limited to one-time verification codes and, if you opt in, team and game notifications (schedule changes, game reminders, roster updates).

  • Consent to receive text messages is not a condition of purchase or of using the Service.
  • Message frequency varies. Typically fewer than 10 messages per month, plus verification codes you request.
  • Message and data rates may apply. Your mobile carrier may charge you; UpIce does not.
  • Reply STOP at any time to unsubscribe. Reply HELP for help.
  • We do not sell, rent, or share your mobile number or SMS consent with third parties for their marketing purposes. See the Privacy Policy, Section 6.
  • Carriers are not liable for delayed or undelivered messages.
